2. Response to DMCA Notices

Upon receiving a valid DMCA notice, 9Pro Casino will:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material that a DMCA complaint has been filed.
  • Terminate repeat infringers’ access to the website, in appropriate circumstances.

3. Filing a Counter-Notice

If you believe that the material removed due to a DMCA notice was wrongly removed, you may submit a counter-notice to our Copyright Agent. The counter-notice must include the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, the jurisdiction of any judicial district in which 9Pro Casino may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

If a counter-notice is received, 9Pro Casino will forward it to the party that filed the original DMCA complaint. If the copyright holder does not file a lawsuit seeking a court order against the alleged infringer within 10 business days of receiving the counter-notice, we will restore the removed material.

4. Repeat Infringers

9Pro Casino reserves the right to terminate, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers of copyright. We may also limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights, whether or not there is any repeat infringement.

5. Misrepresentation

Please note that under 17 U.S.C § 512(f), any person who knowingly misrepresents that material or activity is infringing may be subject to liability for damages. If you are unsure whether material on 9Pro Casino infringes your copyright, we recommend that you first contact an attorney.
